Workplace Safety and Insurance Board Claims

In year 2003, 630,000 Canadians, 460,000 men and 170,000 women were injured in a workplace injury. Nearly 20% of the injuries were injuries to hands while 16% were back injuries. Studies show that those who work in blue collar jobs and those who work long hours more likely to be injured at work. Not all workers report their injuries, but they should. The injury to a person’s back may not appear to be debilitating at first, but over time the injury can worsen and leave the person unable to work and living in pain. After being injury and you cannot return work, filing a WSIB claim can you financially while you are recovering. If your injury is severe and long term, it is critical to initiate a workplace safety insurance claim.

Workplace safety insurance claims are designed to ensure that people injured on the job receive proper care to return to work as soon as possible. If an employee is covered under WSIB benefits at their place of employment, a WSIB claim can be advanced if an injury occurred in the course of their employment. It is not necessary, however, to have an accident at an individual’s place of employment to advance a WSIB claim. It may be possible to advance a disablement claim against the employer in which it is claimed that the injury is as a result of “wear and tear” through years of employment. An employee could also advance a claim on aggravation, reoccurrence or deterioration of a prior work related injury. Any claim should be advanced as soon as an employee is aware of the connection of the injury to work as a six month limitation period exists for the reporting of claims.
