Canada Pension Plan Claims
The Canada Pension Plan pays disability benefits to people who have become disabled and who have paid CPP benefits and are not competitively employable. CPP has minimum contribution requirements which must be met to qualify for disability benefits. Your CPP disability pension claim will be affective by how long you have made CPP contributions and by the amount of your contribution and by the nature of your disability.
A CPP claimant is entitled to Canada Pension Plan (CPP disability) benefits if they have made sufficient contributions to the plan and if their injuries are “severe and prolonged.” Currently, in order to qualify for benefits, you must have contributed to the pension plan for four out of the last six years. Generally, benefits will be awarded where it is established that a claimant has a disability that appears to be permanent and the claimant is not competitively employable.
If a CPP disability claimant can prove that the disability arose within the qualifying period, the CPP disability claim may be approved.
If you’ve been refused for CPP disability benefits, you do have the right to appeal the decision. Your request for an appeal has to be made within 90 days of the last denial letter received. It can be challenge in a CPP disability claim to prove the severity of the disability. Retaining an experienced disability lawyer can help. Contact us to discuss your CPP disability claim.
